One of the biggest complaints from divorce clients is that the entire process is too complicated and it takes too long. Other concerns are the stress and expense of going to court, or spending exorbitant money on attorney fees. Newport Family Law & Mediation Group has developed an innovative solution.

Inspired by the Sacramento and San Diego Superior Court divorce-in-a day programs, but without the Court’s various restrictions, Newport Family Law & Mediation Group now pioneers a ONE DAY, FLAT FEE divorce in Orange County that is offered to those spouses who have an agreement as to all issues, including child custody, visitation, child support, spousal support, and the division of assets and debts, and just want the divorce done so that they can move on with their lives.

An expeditious and cost-effective divorce will preserve your sanity and pocketbook, and most importantly, it will protect the children’s mental, physical and emotional well-being.

WHO IS THIS PROGRAM AVAILABLE TO?

This program is available to spouses who are both self-represented (not represented by attorneys) and who have an agreement as to all issues in their case.

I THOUGHT THAT IT TOOK SIX (6) MONTHS TO FINALIZE A DIVORCE?

Technically, it does. In California, the Court does not have the ability to terminate a marriage and restore spouses to the status of a single person •served. However, this does not mean that you cannot submit your agreement to the Court before that time. What the Court will do is process your paperwork and advance the date stamp to the precise date in the future that coincides with the jurisdictional requirements.

WHAT DOES A “ONE-DAY DIVORCE” ACTUALLY MEAN?

It means that Newport Family Law & Mediation Group will assist you in completing and formally preparing all of the necessary legal documents from start to finish in ONE DAY, including, without limitation, the following:

  • Summons
  • Petition for Dissolution of Marriage
  • Declaration Under UCCJEA (if there are minor children)
  • Venue form (depending on what county in which you reside)
  • Proof of Service of Summons
  • Petitioner’s Declaration of Disclosure Documents
    • Schedule of Assets and Debts
    • Income and Expense Declaration
  • Respondent’s Declaration of Disclosure Documents
    • Same as above
  • Petitioner’s Declaration re Service of Declaration of Disclosure
  • Respondent’s Declaration re Service of Declaration of Disclosure
  • Stipulation and Waiver of Final Declaration of Disclosure
  • Appearance, Stipulations and Waivers form
  • Declaration for Default or Uncontested Dissolution
  • Notice of Entry of Judgment
  • Judgment and attached Agreement regarding child custody, visitation, child support, spousal support, and the division of assets and debts

If either spouse has a retirement/pension plan, a Joinder may be required. Newport Family Law & Mediation Group will evaluate the retirement/pension plan and determine whether a Joinder is required. If a Joinder is required, then Newport Family Law & Mediation Group will prepare, file and serve the Joinder pleadings.

Additionally, if a Qualified Domestic Relations Order (QDRO) is necessary to divide the plan, we will refer you to qualified, highly regarded attorneys who have expertise in this very specialized area.

BISTRO 4000 will cater refreshments and lunch for you.

At the end of your session, you will have a complete Judgment packet in your hands, and the Judgment packet will be submitted to the Superior Court for filing the next business day, unless your case requires a Joinder.

If your case requires a Joinder, then the Joinder will be filed and served first, and the Judgment packet will be filed thereafter.

Newport Family Law & Mediation Group will submit your documentation to the Superior Court for processing, and continue to monitor status until you have received the court-stamped copies back from the Superior Court Clerk’s Office which signifies that your divorce is completed.

HOW MUCH DOES THIS PROGRAM COST?

Newport Family Law & Mediation offers this program for a FLAT FEE of $4,500.00, not including the Court required filing fees. All time expended on your case by all legal professionals, as well and all costs with the exception noted above, are included in the FLAT FEE arrangement.

ARE SATURDAY SESSIONS AVAILABLE IF MY SPOUSE AND I CANNOT TAKE TIME OFF FROM WORK DURING THE WEEK?

Yes, Newport Family Law & Mediation Group offers Saturday sessions upon request.

CAN MY SPOUSE AND I STILL QUALIFY FOR THE PROGRAM IF OUR CASE IS NOT FILED IN ORANGE COUNTY?

Yes, Newport Family Law & Mediation Group offers this program to spouses whose cases are filed in Los Angeles, Orange, Riverside and San Bernardino Counties.
